New Rules for Temporary Rentals in The Costa Blanca in  Spain

We would like to inform you about the new rules and recent legislative changes regarding temporary (holiday) rentals in Spain, with specific attention to the Comunidad Valenciana, including the Costa Blanca North and South. These changes impact both landlords and tenants, so it’s important to stay well-informed.

  1. Registration Requirement
    Landlords are required to register their properties with the local government and obtain a Tourist Accommodation Registration Number (Número de Registro de Viviendas de Uso Turístico). This can usually be done online via the municipality's website where the property is located. The landlord must submit the necessary documents, including:
    • A copy of the title deed.
    • Identification of the landlord.
    • Proof of insurance.
    • A declaration that the property complies with local requirements and standards.
  2. Annual Renewal
    The registration number is valid indefinitely but must be reviewed annually to ensure the property continues to meet all requirements. This is an important change that ensures only properties meeting legal standards can be rented out. Non-registered homes cannot be listed on online platforms like Airbnb.
  3. Exceptions
    If a short-term rental agreement is not published online and is made directly verbally, registration is not required. However, this situation is rare and does not constitute the primary way to bypass the rules.
  4. Landlord Responsibilities
    Landlords are responsible for the maintenance and safety of their properties. This includes compliance with local health and safety standards. It is essential to inform your guests in advance about house rules and emergency procedures.
  5. Information Provision to Platforms
    Online platforms such as Airbnb and Idealista are required to verify that the properties they offer are correctly registered. Landlords must ensure all documents and registrations are in order before listing their property on such platforms.
  6. Changes for Existing Licenses
    Owners who already have a license should check their documentation and ensure compliance with the new requirements. It is essential for existing owners to submit their cadastral reference by August 31 to prevent cancellation of their registration. Owners should update their documents and arrange for an inspection to confirm their property meets current health and safety standards.
  7. Maximum Rental Period
    In certain municipalities, there is a maximum of 90 days per year for renting to tourists. This rule applies in municipalities such as Alicante, Benidorm, Denia, Javea, and Calpe. Be sure to be aware of the specific rules in your municipality.
  8. Insurance
    It is mandatory for landlords to have insurance that covers liability. Contact an insurance company specializing in property rentals to obtain suitable coverage.
  9. Information for Guests
    Landlords must provide their guests with information in advance regarding house rules, emergency procedures, and local amenities. This can be done through an informational document that you email or hand over to guests in person.
  10. Responsibilities of Intermediaries and Agents
    Intermediaries and agents must ensure that the properties they offer comply with all local and national legislation regarding temporary rentals. This means they must be aware of relevant legislation and actively follow it.
  11. Important New Legislation
    Starting January 2, 2025, the Spanish government will introduce a new registration system for short-term rentals. Landlords must obtain a unique registration number for their properties through the Ventanilla Única Digital. This policy is aimed at both private landlords and agents in Spain.
