draft purchase contract, dozens of pages in Spanish, full of legal terms and fine print. The temptation is strong to

paste the text into ChatGPT and ask "Are there any risks in here?" It is free, it is fast and you get an answer

straight away.

We completely understand that reflex. AI is a powerful assistant, and we use it at Moraga every day. But for the

biggest purchase of your life, in a country with a different legal system and a different language, blindly trusting

an algorithm is an expensive gamble. This is why AI is a valuable aid, but never your final decision-maker.

Buying a home in Spain is not a spreadsheet

AI summarises a contract in a second and recognises familiar patterns. But the Spanish property market works

differently from the Belgian or Dutch one. The documents, the procedure, the taxes and even the role of the notary

all follow their own rules. On top of that, you often buy from a distance, in a language that is not your own. And

it is precisely in those local details that the risk lies.

Where AI gets it wrong in Spain

A few concrete examples from practice, where a general AI answer leads you astray:

The nota simple. This extract from the Spanish land registry shows who the real owner is and

whether there are any debts, mortgages or charges on the property. AI can explain what a nota simple is, but not

whether the one for your property is in order. A local expert reads it and immediately spots anything that is off.

The contrato de arras. This Spanish deposit contract works differently from a Belgian or Dutch

preliminary agreement. If you pull out, you usually lose your deposit. If the seller pulls out, they pay back

double. AI often confuses this with rules from other countries.

The licencia de primera ocupacion. This first occupation licence is essential for connecting

water and electricity, and it matters for a later resale. If it is missing, you are buying a problem. An AI model

rarely flags this on its own.

New build and the bank guarantee. If you buy off plan, your payments should be protected by a

bank guarantee. If construction goes wrong and that guarantee is missing, you are left empty-handed. AI knows the

principle, but does not check your specific file.

The recurring costs. Besides the purchase price, there are annual charges: the property tax

(IBI), the community of owners fees and the cost of utilities. AI gives a general answer here, but those amounts

vary widely from town to town and from complex to complex. A local agent knows what you can really expect in your

situation.

And that is before we even mention urban planning legality (is that countryside home actually licensed?), the

coastal law for seafront property, and the transfer tax or VAT that varies by region and by year. Exactly the points

where outdated or general AI information can cost you thousands of euros.

The three golden rules for AI during your search

So should you avoid AI altogether? Absolutely not. You just need to use it wisely.

1. Use AI as a reading aid, not as a notary. Perfect for a first selection or to have a term

explained in plain language. Use that output to ask your agent or lawyer targeted questions, but never take it as

absolute truth.

2. Beware of prompt shopping. Do not ask the same question to ChatGPT, Claude and Gemini.

Different systems use different definitions and nuances. Before you know it, you cannot see the wood for the trees.

3. Always bring in human expertise. An algorithm does not know that a neighbourhood has

foundation problems or that the town hall plans a new road next to your garden. An experienced local agent or lawyer

does, and looks at your situation, your risks and the physical reality of the property.
